From Human Resources to financial analysis, from customer service to code writing, AI's signature is everywhere. However, this massive productivity increase has created an unprecedented "gray area" in terms of data privacy.
1. "Shadow AI" Risk
The most insidious threat companies face is employees using non-corporate-approved AI tools on their own initiative.
An employee pasting a sensitive customer contract into a public generative AI tool to summarize it is an instant data breach.

Companies must establish mechanisms to pass AI-made decisions through human oversight (Human-in-the-loop). Otherwise, the legal validity of the decisions is compromised and creates liability risk.
4. Data Minimization vs. Big Data Hunger
AI models operate on the logic of "more data, better results." However, KVKK mandates the principle of "process only necessary data" (Data Minimization).
Establishing balance between these two opposite poles is the biggest compliance engineering issue of 2026.
Synthetic Data: Using statistically generated artificial data instead of real personal data for AI training is the most modern method that zeroes legal risk.
5. EU AI Act and Its Reflections
Although we are subject to local legislation, the AI Act enacted by the European Union has set a global standard.
