1. Introduction and Definitions
1.1. Parties
These Terms of Service ("Agreement") are entered into by and between:

(hereinafter referred to as "Evaste", "We", "Us", or "Platform")
and the individual or entity accessing or using the Platform ("User", "You", "Your", or "Customer").
1.2. Definitions
"Account": The user account created to access the Platform.
"Services": All GDPR and KVKK compliance management, cookie consent management, privacy policy generation, and related software services provided by Evaste.
"Content": Any text, data, information, graphics, and materials created, uploaded, or shared through the Platform.
"Personal Data": Any information relating to an identified or identifiable natural person as defined under GDPR and KVKK.
"End User": Third parties who visit the User's website or application.
"Subscription Plan": The paid or free service package selected by the User.
"API": Application Programming Interface.
"Widget": The Evaste cookie consent tool integrated into User's website.
1.3. Acceptance of Agreement
By accessing the Platform, creating an account, or using the Services, you represent and warrant that:
- You have read and understood these Terms of Service;
- You agree to be bound by these terms;
- You have the authority to enter into this Agreement;
- You are 18 years of age or older or have legal guardian consent.
If you do not agree to these terms, you must not use the Platform.
2. Service Description and Scope
2.1. Services Provided
Evaste provides the following services:
- Cookie Consent Management: Customizable cookie banners, cookie category management, user consent records, automatic cookie scanning
- Privacy Policy Generation: KVKK-compliant disclosure templates, GDPR-compliant privacy policy templates, automatic update notifications
- Compliance Management: KVKK compliance checklist, GDPR compliance assessment, data processing inventory, consent management reports
- Technical Integration: JavaScript Widget, API access, CMS integrations (WordPress, Shopify, etc.)
2.2. Service Changes
Evaste may at any time:
- Add new features to the Services;
- Modify or remove existing features;
- Suspend all or part of the Services;
- Update the scope of Services.
Material changes will be notified at least 30 (thirty) days in advance via email and/or Platform notification. You may close your account if you do not accept the changes.
2.3. Beta and Trial Services
Services offered as "Beta", "Preview", or "Trial":
- Are provided "AS IS";
- Include no warranties;
- May be modified or discontinued without prior notice;
- Should not be used in production environments.
2.4. Technical Integration Responsibility (CRITICAL)
IMPORTANT: This section governs responsibilities and limitations regarding proper implementation of Evaste Widget, Script, and API integrations.
(a) Integration Obligation
User accepts full responsibility for the following:
- Proper placement of Widget/Script code on their website
- Complete insertion of Script in the specified location (<head> or <body> tag)
- Integration in accordance with Platform documentation
- Post-integration testing and verification
- Timely application of updates
(b) Technical Requirements
User is responsible for meeting the following technical requirements for proper functioning of Evaste services:
- Placing Script in the <head> section or immediately after the opening <body> tag
- Loading Script BEFORE other JavaScript codes
- Configuring Content Security Policy (CSP) to allow Evaste domains
- Configuring CDN or caching systems to not block Script updates
- Meeting supported browser and device requirements
(c) Measurement and Data Collection Responsibility
DISCLAIMER: Evaste shall NOT be held liable under ANY circumstances for measurement errors, data gaps, or incorrect reporting arising from:
- Incomplete, incorrect, or improper Script placement
- Script being blocked or delayed during page load
- Third-party plugins or software blocking the Script
- JavaScript errors on User's website
- Browser compatibility issues
- Cached old Script versions
- A/B testing or tag manager configuration errors
- Single Page Application (SPA) integration errors
(d) Legal Compliance Responsibility and Sanction Exemption
CRITICAL DISCLAIMER:
Evaste shall NOT be held liable in ANY WAY for the following situations arising from User's incorrect, incomplete, or improper integration:
- Administrative fines under KVKK (Law No. 6698)
- Administrative sanctions under GDPR
- Penalties under CCPA or other data protection regulations
- Sanctions arising from inadequate or incorrect consent collection
- Issues arising from incomplete or incorrect cookie scanning
- Issues arising from improper consent record keeping
- Third-party audit or certification failures
- Data subject complaints
- Regulatory authority investigations
- Legal actions and compensation claims
User hereby releases Evaste, its directors, employees, and representatives from all situations listed above and agrees to hold them harmless.
(e) Integration Verification Obligation
User is obligated to perform the following verifications after integration:
- Test that cookie banner displays properly on all pages
- Verify that consent preferences are recorded correctly
- Confirm that cookie scanning detects all cookies
- Test on different browsers and devices
- Use the "Integration Test" tool provided by the Platform
- Regularly check integration status
3. Account Creation and Security
3.1. Account Requirements
To create an account:
- You must provide a valid email address;
- You must provide accurate and current information;
- You must set a strong password;
- For corporate accounts, you must be an authorized representative.
3.2. Account Security
As a User, you are responsible for:
- Keeping your account information confidential;
- Not sharing your password with third parties;
- Immediately reporting unauthorized access;
- All activities performed through your account.
3.3. Account Types
- Individual Account: Single user access
- Team Account: Multiple user access
- Enterprise Account: Custom SLA and support
3.4. Account Suspension
Evaste may suspend your account without prior notice in the following cases:
- Violation of Terms of Service;
- Illegal activities;
- Security threats;
- Failure to meet payment obligations;
- Extended inactivity (more than 12 months).
4. Acceptable Use Policy
4.1. Permitted Use
You may use the Platform only:
- For lawful purposes;
- In accordance with this Agreement;
- In compliance with all applicable laws and regulations;
- For the intended purpose of the Services.
4.2. Prohibited Uses
The following activities are strictly prohibited:
(a) Illegal Activities
- Any activity violating applicable laws
- Fraud or deceptive practices
- Money laundering or terrorism financing
(b) Technical Abuse
- Unauthorized access attempts
- Actions compromising Platform security
- Reverse engineering or source code decompilation
- Automated data scraping
- DoS/DDoS attacks or similar actions
(c) Content Violations
- Malware distribution
- Spam or unwanted content
- Content infringing third-party intellectual property
- Spreading misleading or false information
(d) Service Misuse
- Using the Platform for competitive analysis
- Selling or transferring account credentials
- Attempts to exceed usage limits
- Creating multiple free accounts
5. Intellectual Property Rights
5.1. Evaste's Rights
The following are the exclusive property of Evaste:
- Platform software and source code
- Evaste trademarks and logos
- Platform design and user interface
- Documentation and training materials
- Algorithms and business processes
User is granted only a limited, non-exclusive, non-transferable, and revocable license to use.
5.2. User Content
Rights to content uploaded to the Platform by User ("User Content") remain with the User. However:
- You grant Evaste the license necessary to provide the Services;
- You warrant that the content is legal and does not infringe third-party rights;
- Evaste may use content for anonymized statistical purposes.
6. Payment and Subscription Terms
6.1. Pricing
- Prices are listed on the Platform or in the quote document;
- All prices exclude VAT unless otherwise stated;
- Prices may be in Turkish Lira (TRY), Euro (EUR), or US Dollar (USD);
- Billing cycle may be monthly or annual.
6.2. Payment Methods
Accepted payment methods:
- Credit card / Debit card
- Bank transfer (for corporate accounts)
- Automatic payment instructions
6.3. Late Payments
In case of late payments:
- Reminder notification sent after 7 days;
- Service may be restricted after 14 days;
- Account may be suspended after 30 days;
- Late payment interest may apply (18% annually);
- Collection costs may be charged to User.
6.4. Refund Policy
- Full refund within first 14 days for annual subscriptions;
- No refunds for monthly subscriptions;
- No partial refunds for unused periods;
- Refund requests must be made in writing to info@evaste.co.
7. Service Level Commitments (SLA)
7.1. Availability Commitment
Evaste commits to minimum 99.5% monthly Platform availability (excluding planned maintenance).
7.2. Planned Maintenance
- Planned maintenance notified at least 48 hours in advance;
- Maintenance performed during low-traffic hours when possible;
- Planned maintenance not included in SLA calculations.
7.3. Compensation for Downtime
For Enterprise accounts when monthly availability falls below commitment:

Service credits are applied to the next billing period and are non-refundable.
8. Data Protection and Privacy
8.1. Data Processing
- Evaste processes User's personal data in accordance with the Privacy Policy;
- Full compliance with KVKK and GDPR provisions is ensured;
- Data Processing Agreement (DPA) is provided separately for Enterprise accounts.
8.2. Data Security
Evaste implements the following security measures:
- Data encryption (in transit and at rest);
- Access control and authorization;
- Regular security audits;
- Security breach detection and response systems.
9. Limitation of Liability
9.1. Warranty Disclaimer
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". EVASTE MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- WARRANTY OF MERCHANTABILITY
- WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE
- WARRANTY OF NON-INFRINGEMENT
- WARRANTY OF UNINTERRUPTED OR ERROR-FREE SERVICE
9.2. Liability Cap
EVASTE'S TOTAL LIABILITY UNDER THIS AGREEMENT SHALL IN NO EVENT EXCEED THE TOTAL FEES PAID BY USER IN THE 12 (TWELVE) MONTHS PRECEDING THE CLAIM FOR DAMAGES.
9.3. Indirect Damage Disclaimer
EVASTE SHALL NOT BE LIABLE UNDER ANY CIRCUMSTANCES FOR:
- Loss of profits
- Loss of revenue
- Loss of business opportunities
- Loss of data
- Loss of reputation
- Indirect, incidental, special, or punitive damages
These limitations apply even if Evaste has been advised of the possibility of such damages.
10. Indemnification
10.1. User Indemnification Obligation
User agrees to indemnify and hold harmless Evaste, its directors, employees, and representatives against any claims, damages, losses, costs (including attorney fees) arising from:
- Violation of Terms of Service
- Infringement of third-party rights
- Violation of applicable laws
- Claims arising from User Content
- User's negligence or misuse
11. Termination
11.1. Termination by User
User may at any time:
- Close their account through the Platform;
- Cancel their subscription;
- Terminate the agreement with written notice.
Termination becomes effective at the end of the current billing period.
11.2. Termination by Evaste
Evaste may immediately terminate the agreement in the following cases:
- Material breach of Terms of Service
- Illegal activities
- Payment obligations delayed more than 60 days
- Bankruptcy or concordat filing
11.3. Effects of Termination
Upon termination:
- Platform access is immediately terminated;
- User data is deleted within 30 days;
- Unpaid fees become due immediately;
- Confidentiality obligations continue.
12. Dispute Resolution
12.1. Governing Law
This Agreement is governed by and construed in accordance with the laws of the Republic of Turkey.
12.2. Negotiation
The parties shall first attempt to resolve any disputes through good-faith negotiations. The negotiation period shall not exceed 30 days.
12.3. Mediation
For disputes not resolved through negotiation, mediation is mandatory before filing a lawsuit (pursuant to Turkish Mediation Law No. 6325).
12.4. Jurisdiction
If the mediation process is unsuccessful, Istanbul Courts and Enforcement Offices shall have jurisdiction.
13. General Provisions
13.1. Amendments
Evaste may amend these Terms of Service at any time:
- Material changes notified 30 days in advance;
- Notification via email and/or Platform;
- Continued use after changes constitutes acceptance;
- You may close your account if you do not accept.
13.2. Severability
If any provision of this Agreement is found invalid or unenforceable, it shall not affect the validity of other provisions.
13.3. Non-Waiver
Evaste's failure to exercise or delay in exercising any right does not constitute a waiver of that right.
13.4. Assignment
User may not assign rights and obligations under this Agreement without Evaste's written consent. Evaste may assign the agreement to its affiliates or successors.
13.5. Entire Agreement
This Agreement constitutes the complete agreement between the parties regarding the subject matter and supersedes all prior agreements.
13.6. Force Majeure
Evaste shall not be liable for failures due to:
- Natural disasters (earthquake, flood, fire, etc.)
- War, terrorism, civil unrest
- Government actions, embargoes, sanctions
- Pandemic, epidemic
- Cyber attacks (beyond Evaste's reasonable control)
- Infrastructure provider outages
- Power, internet, or telecommunications outages
If force majeure continues for more than 90 days, either party may terminate the agreement.

User may not assign rights and obligations under this Agreement without Evaste's written consent. Evaste may assign the agreement to its affiliates or successors.
13.5. Entire Agreement
This Agreement constitutes the complete agreement between the parties regarding the subject matter and supersedes all prior agreements.
13.6. Force Majeure
Evaste shall not be liable for failures due to:
- Natural disasters (earthquake, flood, fire, etc.)
- War, terrorism, civil unrest
- Government actions, embargoes, sanctions
- Pandemic, epidemic
- Cyber attacks (beyond Evaste's reasonable control)
- Infrastructure provider outages
- Power, internet, or telecommunications outages
If force majeure continues for more than 90 days, either party may terminate the agreement.

These Terms of Service became effective on January 12, 2026.
